-Simple, by working hard to be better than everyone else and simply being more qualified than the others. What would you want it to be based upon? Special treatment in the event of a minority and qualifications only for the majority?

-The same way the majority of people do, work hard and earn your promotion rather than receive it upon special treatment. Chances are given to everyone mostly in today, and if a bias was found within a firm i'm sure something would be done about it in court. Again, this isn't utopian.
The law is simply outdated i believe. Let's try a revocation of the law and see what happens in major companies. My guess is that the ratios of ethnicities will be relatively the same. You can't change peoples subconcious mentalities towards who they want to hire. But if someone clearly outdoes the other, the minority should never be picked on outside appearances.
dude, first reality is completely different from idealisms of highschool and college lifestyle and beliefs. Yes racism is not tolerated as much as it was before, but that doesn't mean it does not happen. In fact in working world it happens quite frequently, as do corporate politics, backstabbing, and several other things that we were told not to do as early as kindergarten. How can you be so sure that the most qualified gets the position. Based on being behind the scene, i can almost gaurantee that the most qualified person doesn't always get the job. Same goes for anything, applicants to law and medical school, you have 4.0 students, all volunteered in hospital, did their intern, etc etc, exactly the same in qualifications, so how does one choose? throw name in a hat and pick them out? Still I see in modern society people being picked over another for sake of race. Whether qualified or not. The law might need updating, but it still needs to be in place I think. Only in a perfect society can the law not exist...sadly we don't live in one
